Customer Terms.
1. Service description
Welcome to Tillify. These Terms of Use ("Terms") apply to you ("Customer", "you", or "your") when you use the Tillify platform interface to facilitate a payment to a Merchant. By scanning a Tillify QR code or using our interface, you agree to be bound by these Terms.
Tillify Limited ("Tillify", "we", "us", or "our") provides a technical platform that acts as an interface between you and the Merchant.
Important:
- We are not a bank or payment processor. We do not touch, hold, or process your funds at any time.
- We do not sell the goods. The contract for the sale of goods or services is strictly between you and the Merchant.
- Our Role: Our role is limited to providing the software that enables you to instruct your bank or card provider to pay the Merchant directly.
2. How payments work
When you use Tillify to initiate a transaction, you are using our software to trigger a payment through third-party financial providers.
- Bank Transfers (Akahu): If you choose to pay via bank account, our interface allows you to use Akahu to instruct your bank to send funds directly to the Merchant. By using this feature, you agree to Akahu’s Terms and Conditions.
- Card Payments (Stripe): If you choose to pay via card, our interface allows you to connect with Stripe to process the charge. By using this feature, you agree to Stripe’s Terms of Service.
You acknowledge that the actual processing of the payment is performed by these third-party providers and your financial institution, not by Tillify.
3. Refunds and disputes
Because Tillify does not hold funds and does not sell the goods:
- Disputes: Any issues regarding the quality, delivery, or nature of the goods/services must be resolved directly with the Merchant.
- Refunds: Since we do not process the payment, we cannot reverse a transaction or issue a refund. You must contact the Merchant to arrange for any return of funds.
4. Privacy and data
To enable the transaction, we must transmit certain data to the Merchant and the payment providers (Akahu or Stripe).
- We collect transaction details (e.g., amount, reference) to generate the payment instruction.
- We do not store your internet banking credentials. These are handled securely by Akahu.

5. Your responsibilities
You agree that:
- You are the authorised user of the bank account or card used to initiate the payment.
- You will not use the interface for any fraudulent or unlawful purpose.
- You are responsible for ensuring the payment amount entered or confirmed is correct before authorising the transaction.
6. Limitation of liability
To the maximum extent permitted by New Zealand law:
- Technical Failure: We do not guarantee that the Tillify interface or the third-party APIs (Akahu/Stripe) will be uninterrupted or error-free. We are not liable for any loss caused by a failed payment initiation.
- Third-Party Actions: We are not liable for any errors, delays, or actions taken by your bank, Akahu, Stripe, or the Merchant.
- Consumer Guarantees: Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 regarding the provision of our software interface, except where you are using the service for business purposes.
7. Governing law
These Terms are governed by the laws of New Zealand and subject to the exclusive jurisdiction of the New Zealand courts.
